1. Acceptance of these terms
Welcome to What's New LA ("we," "us," "our"), an aggregated guide to concerts, shows, sports, and events across Los Angeles, operated from California, USA. These Terms of Service ("Terms") form a binding agreement between you and What's New LA. By accessing or using whatsnewla.com, signing in, or posting content, you agree to these Terms and to our Privacy Policy, Cookie Policy, and Community Guidelines. If you do not agree, please do not use the service.
2. Eligibility
You must be at least 13 years old to use the service, and at least 16 years old to use the social features (comments, public profile, RSVPs visible to others, and event submissions). By using the service you represent that you meet these requirements and that you are able to form a binding contract.
3. Your account
You sign in using Spotify (OAuth). You are responsible for activity that happens under your account and for keeping your Spotify credentials secure. When you choose a public @handle, it must not impersonate another person or brand, must not be misleading or offensive, and may be reclaimed or changed by us if it violates these Terms or another party's rights. We may refuse, reclaim, or modify handles at our discretion.
4. Acceptable use
You agree to use the service lawfully and respectfully, and to follow our Community Guidelines. In particular, you agree not to:
- scrape, crawl, or harvest content or data except as expressly permitted, or use bots to access the service in a way that burdens our systems;
- post spam, repetitive content, or abusive self-promotion;
- harass, threaten, defame, or abuse others, or post hate speech;
- impersonate any person or entity, or misrepresent your affiliation;
- post unlawful content, infringe others' rights, or violate any applicable law;
- attempt to gain unauthorized access to the service, other accounts, or our systems, or interfere with the service's operation.
5. Your content & license
"Your Content" means anything you post or submit - comments, event submissions, your bio, and similar material. You retain ownership of Your Content. By posting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and adapt Your Content for the purpose of operating, promoting, and improving the service (for example, showing your comment on an event page or displaying your submitted event in the guide).
You represent and warrant that you own or have the necessary rights to Your Content and that it does not violate these Terms, any law, or the rights of any third party. The license you grant survives for content that remains on the service or that others have shared or saved, but otherwise ends when Your Content is removed.
6. Event submissions
When you submit an event, you agree that the information is accurate and complete to the best of your knowledge, and you grant us the right to publish, edit, format, enrich, categorize, or remove it. We may review submissions before publishing, and we may edit or reject any submission for any reason, including accuracy, formatting, duplication, or policy violations. Publishing a submission does not mean we endorse or have verified it.
7. Moderation & enforcement
We may, but are not obligated to, monitor content. We may remove or soft-delete content, hide it, reject submissions, and suspend or terminate accounts that violate these Terms or our Community Guidelines, with or without notice, and at our discretion - including for repeat or severe violations. We are not liable for content posted by users, and we do not endorse user opinions.
8. Third-party content & ticketing (affiliate disclosure)
Much of the event information on What's New LA is aggregated from third parties (such as ticketing platforms, public venue feeds, and data sources) and from user submissions. Links to buy tickets point to third-party ticketers such as Ticketmaster, SeatGeek, and StubHub.
Affiliate disclosure: some of these are affiliate links, and we may earn a commission when you buy tickets through them - at no extra cost to you. We are not the seller or ticketer. When you purchase tickets, your transaction is directly with that third party and is governed by their terms, pricing, fees, and policies. We are not responsible for ticket availability, pricing, fees, fulfillment, refunds, cancellations, or any dispute arising from your purchase.
9. Accuracy disclaimer & "AS IS"
Event details on What's New LA - dates, times, lineups, prices, venues, and availability - are aggregated from third parties and user submissions and may be inaccurate, incomplete, outdated, or changed without notice. Always verify event details and ticket availability directly with the venue or the official ticketer before making plans or purchases.
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EVENT INFORMATION WILL BE ACCURATE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WHAT'S NEW LA AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY EVENT, TICKET PURCHASE, OR THIRD-PARTY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless What's New LA and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your event submissions, your use of the service, or your violation of these Terms or the rights of any third party.
12. Intellectual property
The What's New LA name, logo, design, original text, and the compilation and arrangement of the event guide are owned by us or our licensors and are protected by intellectual-property laws. Except for Your Content, you may not copy, reproduce, or create derivative works from the service without our permission. Event data sourced from third parties remains subject to those parties' rights.
13. Copyright / DMCA
We respect intellectual-property rights. If you believe content on the service infringes your copyright, send a notice to our designated agent at privacy@whatsnewla.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a statement that you have a good-faith belief the use is unauthorized; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act. If your content was removed, you may submit a counter-notice with the corresponding information. We may remove infringing content and terminate repeat infringers.
14. Termination
You may stop using the service and delete your account at any time. We may suspend or terminate your access at our discretion, including for violations of these Terms. Provisions that by their nature should survive termination - including content licenses for content that remains live, disclaimers, limitations of liability, indemnification, and dispute resolution - will survive.
15. Governing law & dispute resolution
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Before filing any formal dispute, you agree to first contact us at privacy@whatsnewla.com and attempt to resolve the matter informally for at least 30 days.
If we can't resolve a dispute informally, you and we agree to resolve it by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small-claims court. You and we waive the right to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms. To the extent any dispute proceeds in court, the state and federal courts located in California will have exclusive jurisdiction and venue. Nothing here limits rights you cannot waive under applicable law.
16. Changes to these terms
We may update these Terms from time to time. We'll revise the "Last updated" date above, and for material changes we'll take reasonable steps to notify you. Your continued use of the service after changes take effect means you accept the updated Terms.
